What is the European Accessibility Act?
The European Accessibility Act is a European directive that aims to improve the functioning of the internal market for accessible products and services by eliminating obstacles created by divergent rules in Member States and eliminating direct and/or indirect discrimination against people with disabilities.

Websites involved: 
The compliance obligation applies to all sites that sell products or services online.

What are the legal obligations for websites?
Companies must ensure that their websites are accessible according to recognized technical standards, which define requirements for the perception, operability, comprehensibility, and robustness of digital content.

Compliance Deadline: 
Starting June 28, 2025 for Italy, Spain, and the rest of the EU countries

Supervisory Authorities: 
Responsible for monitoring websites, mobile apps, and e-commerce are AgID (for Italy), the Ministry of Economic Affairs and Digital Transformation (for Spain), and the respective authorities identified by the domestic legislation of the remaining EU countries. They have full powers of oversight, requesting corrective measures, imposing sanctions, and, in serious cases, adopting service blackout measures.

Measures and Penalties: 
Non-compliant businesses will be subject to various types of controls, including tax audits. Penalties for non-compliance range from €5,000 to €40,000 for minor violations, and up to 5% of annual turnover for failure to implement corrective measures following an order from the competent authority. Additionally, additional penalties may apply, such as exclusion from public tenders or European funding.
